The Supreme Court’s recent FBI v. Fazaga decision regarding surveillance has been interpreted by some as an obstacle to Biden administration efforts to secure an effective replacement for the EU-U.S. Privacy Shield. Originally implemented in 2016, thousands of U.S. companies had been relying on the Privacy Shield to centralize customer data. In 2020, the Court of Justice of the European Union (CJEU) nullified the framework after finding U.S. surveillance laws provide a loophole for unauthorized access to data belonging to EU citizens. Twitter Rallies Midsize Tech Around the Open Internet Alliance

Twitter has used its Spaces platform to opine on rapidly developing EU digital regulations, an effort that after two years has become formalized as a policy advocacy group known as the Open Internet Alliance. Vimeo, Automattic, Czech search engine firm Seznam and German social network Jodel have joined Twitter as founding members. Amazon Closes $8.5B Deal for MGM, FTC Watches in Wings

Amazon completed its $8.5 billion acquisition of MGM late last week. The companies finalized the deal immediately upon expiration of the Federal Trade Commission’s mid-March deadline to object, though the agency let it be known that it can challenge a deal any time it finds cause. Amazon in May announced intent to acquire MGM, which has a library of more than 4,000 films and some 17,000 TV episodes as well as ongoing production in both areas. EU Digital Markets Act Poised to Compel Apple ‘Sideloading’

The EU is preparing to finalize its Digital Markets Act (DMA) designed to neutralize Big Tech’s gatekeeper status by leveling the playing field with smaller competitors. The DMA, which could be completed by month’s end, has ramifications for Amazon, Google and parent Alphabet, and especially for Apple, which faces what some describe as an existential threat through provisions that would allow software to be downloaded outside the App Store and third-party payment systems inserted on apps, known as “sideloading.” Failure to comply could carry fines and penalties totaling tens of billions of dollars. Study Finds Consumers Embraced Voice Shopping Last Year

Voice shopping over smart devices rose to 45.2 million in 2021, a 120 percent increase in three years, reflecting a 30 percent compound annual growth rate according to Voicebot Research, which tracks use of voice-assisted devices. The analytics firm found that 20.5 million U.S. adults had used voice to shop for a product at least once in 2018. That figure rose to 45.2 million in 2021. However, the firm found that general-use smartphone voice assistants — such as those from Apple (Siri), Amazon (Alexa) and Google — declined 2.8 percent among U.S. adults in 2021. Innovative California Privacy Law Sets Stage for Entire Nation

As the first state to implement privacy laws protecting consumers from Big Tech, California is being closely watched as it puts together a governing body with the job of regulating how Amazon, Google, Meta and other companies collect and exploit data from millions of people. Facebook Gaming Inundated by Spam, Strange Infomercials

Facebook Gaming has been invaded by spammers and infomercials, according to recent reports that found Ukrainian war footage and video clips featuring individuals hawking foot callus removal kits and diet pill purveyors posted on what was supposed to be Meta Platforms’ answer to Amazon’s Twitch. Some of the videos masquerading as “live” featured up to 11 hours of looped recordings. In late 2021, Facebook Gaming listed seven such spurious accounts in the Top 10, sometimes attracting as many as 50,000 simultaneous viewers, according to data analytics firm Stream Hatchet. Twitch Aims to Remove Channels That Spread Misinformation

In an effort to thwart misinformation, Amazon-owned live-streaming video service Twitch is cracking down on bad actors. “We do not believe that individuals who use online services to spread false, harmful information, have a place in our community,” the company stated. Twitch worked with researchers and experts to identify three characteristics that all bad actors share: an online presence dedicated to (1) persistently sharing (2) widely disproven and broadly shared (3) harmful misinformation topics, such as conspiracies that promote violence. Amazon Luna Streaming Game Service Launches with Twitch

After a year of limited availability, Amazon is officially launching its Luna cloud streaming subscription game service in the U.S. with new channels and integration with Prime and Twitch. Amazon Prime Gaming already offers a quantity of downloadable monthly games. Luna+ expands those offerings and adds three new a la carte channels — for Twitch, Jackbox Games and arcade favorites. “Play high-quality and immersive games, without lengthy game downloads, hardware upgrades, or game updates,” Amazon announced. Data Act Aims to Protect EU Consumers in Smart Device Era

The European Commission has proposed new rules on who can use and access data generated across economic sectors in the European Union. The proposed legislation would require Amazon, Microsoft, Google and other cloud service providers as well as those who harvest data to establish safeguards preventing non-EU governments from illegally accessing EU consumer information. “We want to give consumers and companies even more control over what can be done with their data, clarifying who can access data and on what terms,” said Margrethe Vestager, the EC’s commissioner for competition, in announcing the Data Act.
