U.S. government agencies have 30 days to remove the TikTok app from federal devices and systems, the White House said Monday. A memo from Office of Management and Budget director Shalanda Young advised that in the interest of national security, the China-owned app must be purged from phones and Internet traffic firewalled from reaching it. The government ban was ordered by Congress in December, and follows similar moves in Canada, Taiwan, the EU, and many U.S. states. The European Commission has proposed new rules on who can use and access data generated across economic sectors in the European Union. The proposed legislation would require Amazon, Microsoft, Google and other cloud service providers as well as those who harvest data to establish safeguards preventing non-EU governments from illegally accessing EU consumer information. “We want to give consumers and companies even more control over what can be done with their data, clarifying who can access data and on what terms,” said Margrethe Vestager, the EC’s commissioner for competition, in announcing the Data Act. The European Parliament and EU Member States have reached an agreement on the Data Governance Act, clearing the way for final approval on legislation. The Data Governance Act is a framework designed to encourage sharing under the General Data Protection Regulation (GDPR), consumer protection laws and competition rules. The goal is to develop common European data spaces in areas such as manufacturing, cultural heritage and health. The Data Governance Act is the first of two steps. The EU’s Data Act — which promotes data sharing among EU member states, businesses and government — will soon be formally proposed. Senator Kirsten Gillibrand (D-New York) has revisited her Data Protection Act of 2020 to add the creation of a government agency that would regulate and enforce federal privacy laws. She noted that, “Big Tech companies are free to sell individuals’ data to the highest bidder without fear of real consequences … a data privacy crisis is looming over the everyday lives of Americans.” The revamped version, more likely to be passed during the Biden administration, also includes sections on antitrust and civil rights.
