European regulators on Monday hit Apple with an antitrust charge, alleging it has created a “closed system” for contactless mobile payments. The so-called statement of objections says the iPhone maker has abused its market power by favoring its Apple Pay for mobile contactless payments to the detriment of third-party services like PayPal, which reportedly helped initiate the charges. The European Commission says it has reason to believe Apple withheld access to its NFC inputs in order to suppress other mobile-wallet app developers from competing with Apple Pay, which the Commission called “a closed ecosystem.” Continue reading EU Hits Apple with Antitrust Objections Over Mobile Payments

Epic Games has raised $2 billion in a funding round that will fuel the company’s ambition to build a metaverse. Investments of $1 billion each came from existing shareholder Sony Group and Kirkbi, the family-owned company that owns 75 percent of the Lego Group. Epic continues to have a single class of common stock outstanding and remains controlled by founder and CEO Tim Sweeney, who launched the company in 1991. The fresh funds — the largest game company raise since 2002, according to PitchBook Data — positions Epic’s post-money equity valuation at $31.5 billion, the company says. After nearly a year in preview, Epic Games’ Unreal Engine 5 is now in general release. Availability of the next-generation real-time 3D platform was announced at Tuesday’s State of Unreal 2022 event. Empowering “both large and small teams to really push the boundaries of what’s possible, visually and interactively,” UE5 offers more fidelity and flexibility than previous iterations. Although it has been battle-tested on “Fortnite” and “The Matrix Awakens” demo for PlayStation 5, Epic says some UE5 features “have not yet been validated for non-games workflows.” Continue reading Epic’s Unreal Engine 5 Out of Preview and Into Wide Release

The European Parliament and EU member states reached agreement Thursday on key points of the Digital Markets Act, a sweeping measure poised to reshape the technology landscape in Europe and potentially around the world. The DMA objectives are two-fold: reining in anticompetitive measures that advantage Big Tech over competitors and consumers, and putting teeth to the new rules. Considered the biggest digital regulatory expansion anywhere in decades, the proposal has been criticized for singling out U.S. firms like Amazon, Apple, Meta and Alphabet, all of which fall into the gatekeeper category targeted by the act. As the Renaissance was a reaction to the Dark Ages that preceded it, so too the entertainment industrial complex finds itself on the brink of a fruitful new era of technological and creative achievement triggered by COVID-19. The need for remote production has encouraged a cross pollination of new tools and techniques that will likely lead to significant change in the next era of media production. Roaring back to an in-person event in Rancho Mirage last week after hosting a virtual summit in 2021, the HPA Tech Retreat 2022 showcased the groundbreaking exchange between content-makers and tech providers. Epic Games has purchased online music store and community Bandcamp. Citing a shared “mission of building the most artist friendly platform that enables creators to keep the majority of their hard-earned money,” the blockbuster game developer explained in a statement that Bandcamp will play an important role in the gamer’s “vision to build out a creator marketplace ecosystem for content, technology, games, art, music and more.” It’s an interesting strategic move. Competitor Electronic Arts has had success with music, getting its “Star Wars” scores released and creating hits through its “FIFA” and “Madden NFL” games. “A world without synthetic humans is not an option anymore,” the audience at the 2022 HPA Tech Retreat in Rancho Mirage were advised by “Fathead” virtual production producer Tom Thudiyanplackal. Equally unimaginable is a world without synthetic sets, as was obvious at Tuesday’s daylong HPA Super Session, themed “Immerse Yourself in Virtual Production.” “Fathead,” the fifth short from the USC Entertainment Technology Center’s Annual ETC Innovation and Technology Grant, was all about in-camera VFX, captured in real-time on a stage lined and lidded with LEDs — 280-degrees around and on the ceiling, too. The legislative tide seems to be turning against Apple and its App Store, marking what some note is a shift in attention previously trained on Meta Platforms and its alleged child endangerment through Facebook and Instagram, Amazon’s behavior toward its retailers, and Alphabet’s advertising controls on Google. The Apple attack is building worldwide, as Dutch antitrust watchdog Authority for Consumers and Markets (ACM) on Monday fined Apple $5.7 million over what it says are abusive payment requirements that prohibit developers from using third-party platforms for dating app fees. Microsoft CEO Satya Nadella thinks the metaverse will be transformative. “Just like the first wave of the Internet allowed everybody to build a website, I think the next wave of the Internet will be a more open world where people can build their own metaverse worlds, whether they’re organizations or game developers or anyone else,” Nadella told analysts on an earnings call last week. The remarks follow Nadella’s January 18 statement that Microsoft’s $69 billion bid for Activision Blizzard “will provide building blocks for the metaverse.” Microsoft expects the deal to close in fiscal 2023, which begins July 1. The Senate Judiciary Committee voted Thursday to advance a bill designed to level the playing field between Big Tech and smaller players forced to rely on the giant firms to reach customers. Allegations that the behemoths abuse their power to subjugate competitors and exploit consumers permeate Capitol Hill. After being reminded by Senator Amy Klobuchar (D-Minnesota) that antitrust laws haven’t been meaningfully updated “since the birth of the Internet,” the American Innovation and Choice Online Act was advanced on a bipartisan basis, setting it on a path for a full Senate vote. Brands have begun dabbling in the metaverse. Chipotle, Vans and Nike are among those experimenting on Roblox, a platform where users play games, while Verizon staged a stadium game in Fortnite Creative, an affiliate service of the popular Epic game. Meta, the company formerly known as Facebook is said to be encouraging brands to use Instagram’s AR filters to get acclimated to the metaverse. There are reports that Apple is preparing its own meta debut, with Taiwan-based analyst Ming-Chi Kuo predicting, presumably based on his supply-chain sources, that Apple plans to unveil an AR wearable late next year. Following an announcement in August that it had settled a class action lawsuit, Apple has introduced new App Store Review Guidelines. Specifically, Apple now permits its registered developers to communicate to customers how they may pay for iOS apps using payment means outside iOS and Apple’s App Store. The guidelines now explain developers may request customer information, including name and email, but must permit customers to provide that information at their discretion. The third change is how to use a new Apple feature called in-app events that Apple says is unrelated to litigation. Continue reading New Apple Guidelines Permit Payment Outside of App Store
