TikTok toured journalists through its new Transparency and Accountability Center last week. Located in Culver City, the facility features monitors displaying infographics that show how TikTok’s recommendation engine and content moderation affect the short-form videos that are the basis of its viral app. Computer workstations running a “code simulator” were made available so visitors could explore firsthand how the app’s algorithms influence video propagation. TikTok COO Vanessa Pappas told attendees that the new center, in development since 2020, aims to give lawmakers and others a more personal experience than the virtual tours previously offered. Chuck Grassley (R-Iowa) and Amy Klobuchar (D-Minnesota) of the Senate Judiciary Committee are working together on antitrust legislation similar to some of the measures the House Judiciary Committee approved last month. U.S. antitrust laws date back to the days of Big Oil. When a federal judge this week dismissed antitrust lawsuits brought against Facebook by the Federal Trade Commission and 48 states, experts called for a modernization of the laws themselves. U.S. District Court for the District of Columbia judge James Boasberg dismissed antitrust lawsuits against social media giant Facebook brought by the Federal Trade Commission and 48 states. The judge said the states waited too long to bring up a case on deals made in 2012 and 2014 and that prosecutors failed to prove that Facebook holds a monopoly over social networking. The FTC can bring the case back in 30 days but the judge said it would require a lot more detail. Facebook’s stock rose 4.2 percent in the wake of the news. Despite significant lobbying efforts by technology companies, the House Judiciary Committee approved the Ending Platform Monopolies Act, the final of six bills proposed to restrict Big Tech’s dominance. The Committee also approved the American Choice and Innovation Online Act, which would ban Big Tech from advantaging their own products, disadvantaging rivals or discriminating between “similarly situated” business users and another bill that would require them to make it easier for users to transport their data to other platforms. The House unveiled five bills aimed at curbing Big Tech companies, including the Ending Platform Monopolies Act, that requires “structural separation of Amazon” and makes it illegal for an online platform to own a business that uses said platform for “the sale or provision of products or services,” that “sells services as a condition for access to the platform” or that “owns businesses that create conflicts of interest.” Another bill would ban platforms from giving advantage its own products and services over those of a rival. The Pentagon may end the JEDI (Joint Enterprise Defense Infrastructure) cloud-computing project, awarded to Microsoft in 2019. Since then, it has been in litigation with Amazon, which was passed over for the $10 billion contract that will consolidate the Pentagon’s array of data systems and provide access to real-time information. As the Australian law requiring Google and Facebook to pay publishers for content nears passage, news publishers in the European Union are urging legislators to copy that law. The European Publishers Council supports the Digital Markets Act (DMA) to be included in legislation, forcing binding arbitration if the two parties can’t agree on payments. In the U.S., Congress members intend to introduce legislation to make it easier for smaller news organizations to negotiate with Facebook, Google and other Big Tech platforms. As incoming head of the Senate antitrust subcommittee, Senator Amy Klobuchar (D-Minnesota) renewed her call to legislate major changes to U.S. trust laws. Specifically, the legislation would prevent companies that dominate in a sector from purchasing other companies unless they can prove the deals don’t “create an appreciable risk of materially lessening competition.” Klobuchar suggested such changes in Congress’ previous session and Republicans largely rebuffed them. Amazon’s robust holiday shopping quarter garnered $125.5 billion in sales and net income of $7.2 billion, the first time the company reached $100+ billion in quarterly revenue, and only days after Apple achieved the same milestone. Amazon amped up sales when it moved its two-day Prime Day shopping event from summer to October. The company’s overall 2020 sales hit $386.1 billion, a 38-percent year-over-year jump. After an 18+ month investigation, the Federal Trade Commission and regulators from 46 states have officially accused Facebook of anticompetitive behavior by purchasing rivals. The separate lawsuits were filed in the U.S. District Court for the District of Columbia. Facebook currently owns three major messaging apps and the suits call for the company’s purchase of Instagram (for $1 billion in 2012) and WhatsApp (for $19 billion in 2014) to be undone. After a 16-month investigation, the House Judiciary Committee presented a 449-page report stating that Big Tech companies Amazon, Apple, Facebook and Google abused their monopoly positions and calling for reform of the antitrust laws. Lawmakers stated the companies had evolved from startups to “the kinds of monopolies we last saw in the era of oil barons and railroad tycoons” and stated their breakup would restore competition.
