The Supreme Court’s recent FBI v. Fazaga decision regarding surveillance has been interpreted by some as an obstacle to Biden administration efforts to secure an effective replacement for the EU-U.S. Privacy Shield. Originally implemented in 2016, thousands of U.S. companies had been relying on the Privacy Shield to centralize customer data. In 2020, the Court of Justice of the European Union (CJEU) nullified the framework after finding U.S. surveillance laws provide a loophole for unauthorized access to data belonging to EU citizens. The European Union’s top court voided a transatlantic data-sharing pact this week, ruling that EU residents’ data, when moved to the U.S., are not sufficiently protected from that government’s surveillance. The legal battle began in 2013, when privacy activist Max Schrems complained to the Irish Data Protection Commissioner, pointing to Edward Snowden’s leaks as proof that U.S. law did not protect against scrutiny. Marking a world first, social giant Facebook has agreed to turn over data of French users who are suspected of hate speech on the popular platform. Cédric O, state secretary for the digital economy of France, who has been influential in shaping French President Emmanuel Macron’s perspective on Big Tech, made the announcement yesterday. The Facebook decision follows a number of successive meetings between President Macron and Facebook CEO Mark Zuckerberg. It has been reported that Macron is actively interested in regulating hate speech worldwide and taking control of false information online.
