Ruling Against FilmOn Shows Aereo Issues Are Not Resolved

FilmOn just lost its latest court case, with U.S. District Judge Rosemary Collyer’s ruling that the company is not a cable system, denying it the statutory license cable companies receive. Collyer’s ruling comes as good news to the coalition of TV and movie companies — including ABC, CBS, NBC, Fox and Telemundo — that sued FilmOn in 2013. The new ruling goes against the July ruling from a Los Angeles Federal judge that went in favor of FilmOn, and also revives many of the same questions behind the Aereo ruling. Netflix Doubles Down on Movie Production with $50M for ‘Okja’

On the heels of its first original theatrical film acquisition, “Beasts of No Nation,” Netflix is financing “Snowpiercer” director Bong Joon-ho’s next film, “Okja,” to the tune of $50 million. The film, which stars Jake Gyllenhaal, Tilda Swinton and Paul Dano and will be produced by Brad Pitt/Dede Gardner’s Plan B, marks the next step of the streaming media company’s transition to film production studio. T-Mobile Launches Binge On: Video Streaming, No Data Cap

T-Mobile US will stream 24 video services including Netflix, Hulu and HBO for free, albeit at lower quality. The wireless company has already used this tactic — called zero rating, which means the data will not be counted against the subscriber’s data limit — for its Music Freedom service, which includes music streaming apps Spotify and Apple Music among others. The new video exemption, dubbed Binge On, does not, however, include video from YouTube, Facebook and Netflix and requires users to have a 3GB plan or larger. Sony Pictures to Release Titles on UHD Blu-ray Disc in 2016

Sony Pictures Home Entertainment (SPHE) will release a slate of films in the Ultra HD Blu-ray Disc format in 2016, becoming the second studio, after Twentieth Century Fox Home Entertainment, to do so. As sales of Ultra HD television sets soar, so does the need for Ultra High Def content making Sony Pictures movies a natural fit. Some experts say that growth in Ultra HD may lead to an uptick in sales of Blu-ray Disc players as the best way to watch UHDTV. Lionsgate also announced plans to remaster its top 100 movies in UHDTV. China’s LeTV Brings VR Headset, Smart TV, More to the U.S.

Though LeTV is little known in the U.S., that’s about to change. The Chinese online video and consumer electronics behemoth, which posted an estimated $1.6 billion in revenue last year, is about to introduce U.S. consumers to its Android-based smartphone, a bike with an integrated GPS device, smart TVs with voice control, a 4K video streaming box and a VR headset. The company plans to initially focus on the 3 million Chinese speakers in the U.S. but has also inked a two-picture deal with “Lion King” director Rob Minkoff. Flare MeTV: Cox to Roll Out New Streaming Content Service

In an attempt to attract and maintain the youth demographic, Cox Communications plans to debut Flare MeTV, featuring a variety of streaming offerings, by the end of 2015. Similar to Comcast’s “Watchable,” which debuted in September, and Verizon’s go90, Flare MeTV will aggregate online video content and may in the future carry some licensed traditional TV content. Flare MeTV will be introduced as free without ads, but may eventually become ad-supported or subscription-based. Activision to Open Film/TV Studio to Repurpose Game Library

Gaming company Activision Blizzard is creating an internal film/TV studio, headed by former Walt Disney Company executive Nick van Dyk, to produce content based on its 1,000-title library. The first production is animated TV series “Skylanders Academy,” based on the “Skylanders” game that’s earned $3+ billion since its 2011 launch. The first film is likely to be based on “Call of Duty.” This move comes on the heels of Activision’s stated intent to acquire King Digital Entertainment, creator of “Candy Crush,” for $5.9 billion. YouTube Democratizes VR, Stays a Step Ahead of Competition

YouTube is introducing 360-degree VR videos as well as a virtual movie theater for all YouTube videos. Anyone with a Google Cardboard headset and the Android app can begin viewing the ten or so VR videos that YouTube produced; the iOS app is coming soon. YouTube’s VR features come just before The New York Times ships 1.3 million Google Cardboard sets and its own VR documentary, “The Displaced.” YouTube’s assertive move into VR is widely seen as a way to stay a step ahead of the competition, Facebook in particular. On the first day of Variety’s Big Data Summit, the main takeaway was that data — from online, set-top boxes, smartphones and even retail sales — has become a tidal wave that threatens to overwhelm even data experts. In the world of UHD/4K, movies and TV programs can require massive amounts of compute power. Take a recent 50-minute UHD natural history documentary that Sundog Media Toolkit worked on. Chief executive Richard Welsh reports it ran for four hours on over 5,000 processors. SMPTE 2015: Verizon’s Middleton Says Linear TV Is Not Dead

At the Industry Luncheon on SMPTE 2015’s second day, Verizon Digital Media Services chief product officer Ted Middleton delivered the keynote address, which was, in part, a paean to the joys of linear TV. The luncheon also honored Wendy Aylsworth, the first woman to be SMPTE president, and showed a trailer for “Moving Images,” a retrospective of the science and engineering behind the industry’s cinema and television, directed by Howard Lukk and sparked by SMPTE’s upcoming 100th anniversary.
