Since Baidu began creating and licensing content, the Chinese search engine titan has become focused on protecting copyright, a complete U-turn from the days when it was often accused of being a pipeline for pirated content. Among its newly licensed content are original shows from Netflix. Data from China’s Supreme People’s Court reveals that almost 87,000 copyright-related cases were filed in the country in 2016, a figure that is 15-times more than the cases filed ten years previously. According to the Recording Industry Association of America and 14 other groups, the 19-year-old Digital Millennium Copyright Act (DMCA) needs to be updated. They’re telling the U.S. Copyright Office that new piracy controls are required. Currently, ISPs that “expeditiously” remove copyrighted content when alerted by rights holders get legal immunity or so-called safe harbor. But the RIAA and others say this process is not sufficient, as the pirated copy reappears instantly, requiring yet another takedown notice. Internet service providers, Hollywood studios and record labels have opted not to extend their pact to combat peer-to-peer piracy via the voluntary program that involved issuing “copyright alerts” to offenders. The voluntary program was launched in 2013 as a means of fighting piracy without calling for congressional legislation. Internet users who accessed pirated P2P content were issued warnings, and “six-strike” repeat offenders faced penalties such as the slowing of their Internet delivery. Despite shifts in music consumption involving streaming services, Internet radio, digital downloads and more, many consumers are still purchasing CDs. However, the revenue does not always reach the artists and labels responsible for the music, since piracy is running rampant in the form of counterfeit CDs offered through online retailers such as Amazon. Counterfeits are becoming increasingly difficult to distinguish from the official versions. While CD sales represented a mere 13 percent of revenue for U.S. labels the first half of this year, they accounted for almost 40 percent of global revenue for the recording industry last year. Sony, Universal, Warner Bros. and other record labels are taking legal action against the German operator of website YouTube-mp3.org, claiming that the industry is being robbed of revenue from streaming, downloads and advertising. BBC notes that the site provides an easy-to-use method of downloading audio from YouTube videos. The labels filed the suit in a federal court in Los Angeles, seeking damages including $150,000 per each alleged act of piracy. According to the labels, “tens, or even hundreds, of millions of tracks are illegally copied and distributed by stream-ripping services each month.” YouTube-mp3.org is described as the “chief offender,” with more than 60 million monthly users. Pandora unveiled Pandora Plus, replacing the 16-year old company’s original ad-free service. What’s different is that the company now licenses music from the major record labels, rather than using compulsory licenses from the government, with rates determined by federal judges. With the new version, users can replay or skip songs and listen offline. The monthly price remains $4.99. Out of Pandora’s nearly 80 million users, only 4 million are paying subscribers. The recording industry is concerned about a burgeoning trend: stream-ripping. Numerous mobile apps and sites now allow users to download MP3 files from songs on YouTube, thus circumventing both advertising and paid streaming services such as Spotify and Apple Music. The music industry has had reasonable success in fighting the kind of peer-to-peer file sharing that hurt CD sales, but this new kind of piracy is proving much harder to combat because it sources legitimate streaming services. This year, for the first time, streaming music topped digital downloads as the largest source of music revenue in the U.S. The two biggest sources are Spotify and Apple Music, but SoundCloud, Deezer, Tidal and Google Play are also active. Now, both Amazon and Pandora are readying their entries into this crowded market. Both companies have almost locked-up licensing deals with the largest record labels. In the latest battle between musicians and streaming outlets, the music industry has united to fight YouTube for higher royalties. Katy Perry, Pharrell Williams and Billy Joel signed letters requesting changes to copyright laws; high-profile manager Irving Azoff criticized YouTube in an interview and a Grammy Awards speech. An International Federation of the Phonographic Industry (IFPI) report points out that 20 million Americans, and 20 percent of the world’s population, still pirate music. Now, the IFPI will soon join the record labels’ trade group the RIAA in complaining that YouTube doesn’t pay a fair price for the music it gives away for free. As revenue from streaming rose 29 percent last year, artists and the recording industry are renewing their effort to get the U.S. Copyright Office to take a second look at the “safe harbor provisions” of the 1998 Digital Millennium Copyright Act. They say that places the onus on policing copyright infringement on them, protecting services such as YouTube where copyrighted material is uploaded without permission. Berlin-based SoundCloud, which began signing licensing deals with major and indie record labels in 2014, just debuted its new subscription plan. The online music service’s 175 million regular users will now have the option of the free version, which features 100 million songs, or the $10/month subscription version, SoundCloud Go, which offers 125 million ad-free songs, and lets users save songs to their phones. In the first 12 weeks this year, Google received takedown requests for 213 million links, representing a 125 percent increase over the same period in 2015, to remove copyright infringing sites, as per the Digital Millennium Copyright Act. The spike does not represent a dramatic increase in piracy but, rather, new automated tools for finding copyright violators as well as more copyright holders actively looking for infringers. The Recording Industry Association of America reports that streaming is booming, more than offsetting declines in CD sales and digital downloads. In 2015, overall revenues rose almost 1 percent to $7 billion, the fifth consecutive year that the market grew — albeit slightly — in wholesale value. But artists and their representatives are saying that the gains aren’t being fairly shared, since many users still listen for free. The organization that awards gold and platinum record certifications to top selling artists has updated the way it counts album sales to include streaming data. The Recording Industry Association of America will now count 1,500 audio or video song streams as ten track sales, which equals one album sale. An artist’s album will achieve gold record status when it sells more than 500,000 copies and platinum record status when it sells more than 1,000,000 copies.
