Apple has been in discussions with cable companies and television networks for more than a year regarding licensing agreements for a new service that would allow viewers to access live and on-demand television via an Apple set-top box or TV. In recent discussions, the company reportedly told media execs it hopes to offer a premium version that enables viewers to skip ads. Fox Considering an Appeal to Supreme Court in Aereo Battle

On Tuesday, the U.S. Second Circuit Court of Appeals refused TV broadcasters’ petition to appeal an earlier ruling that Internet-streaming startup Aereo is legal in New York City. The appeal came from Fox, CBS and others. Judges were polled and a majority did not want to rehear the case, although Judge Denny Chin called Aereo a “sham” and harmful to the TV industry. Fox Broadcasting is reviewing its options and may appeal to the U.S. Supreme Court. Hulu Owners Call Off Sale, Announce New Investment Plans

The three companies that mutually own Hulu announced on Friday that they would not be selling the video site, bringing an end to months of bidding and speculation. Instead, the current owners of Hulu — 21st Century Fox, Disney and NBCUniversal — explained that they plan to invest $750 million to compete against online video services such as Netflix and Amazon. Hulu Bidding Concludes, Reportedly Down to Three Suitors

The bidding process for Hulu concluded on Friday and the Los Angeles-based streaming media company has reportedly narrowed down the list of suitors to DirecTV, The Chernin Group and Guggenheim Digital Media. Previous offers had reached at least $1 billion, people familiar with the dealings said in May. Some reports suggest that DirecTV may be the likely frontrunner, since the satellite TV provider could have the most to gain. Gamification: Max Wants to be Your Personal Netflix Host

Netflix has launched a new recommendation service called “Max” that chats with users and plays amusing games to help viewers discover new TV shows and movies. The games center on genres and actors to help gauge user preferences. Available only on the PlayStation 3 for now, the Netflix blog reports that Max will be available for other devices in the future, with the iPad version expected next. FlareWatch: Cox Targets Cord-Cutters with Internet TV Trial

Cox Communications is offering a beta version of a broadband TV service that delivers lower-priced live television and DVR storage to subscribers in southern California. The company’s flareWatch trial marks the first time a major U.S. pay TV operator is specifically targeting cord-cutters. The IPTV service uses Fanhattan’s $99 Fan TV set-top box, which features a touch-sensitive remote control. Black Box Project: Intel Readies Internet TV Service and STB

We previously reported that Intel was moving forward with its planned Internet TV service and set-top box, and noted earlier this month that the chip giant was pursuing programming deals, reportedly offering to pay as much as 75 percent more for content than traditional cable rates. In March, the company started conducting closed trials, code-named the “Black Box Project,” with company employees. Study Shows Increase in Cord-Cutting and OTA Households

According to a new GfK study released last week, 19.3 percent of U.S. television households access their TV from free over-the-air (OTA) broadcasts. This represents 22.4 million households (59.7 million consumers) who currently get their TV exclusively via broadcast-only reception. New data from GfK’s Media and Entertainment team suggests that 60 percent cited cutting costs, while far fewer mentioned that cord-cutting was the result of increased online viewing options. Apple iTunes and Netflix Dominate the Online Video Market

Newly released statistics indicate that Apple’s iTunes and subscription service Netflix continue to lead the Internet video market. Earlier this month, we reported that Netflix held a clear lead in SVOD viewership over Hulu and Amazon for Q1. Yesterday, Apple announced that iTunes viewers are purchasing more than 800,000 TV episodes and 350,000 movies per day. Fresh: Amazon Brings Online Grocery Shopping to Los Angeles

Amazon recently announced plans to offer online grocery shopping in Los Angeles. While the $79 Amazon Prime provides customers with two-day shipping and streaming TV shows and movies, the $299 AmazonFresh Service, originally tested in Seattle, will additionally enable members to order groceries that will be delivered to the door in hours. Retail giants such as Walmart and Costco have suggested that online grocery delivery is a nearly impossible business. Music Publishing Turmoil: BMI Files Lawsuit Against Pandora

Music licensing giant Broadcast Music Inc. filed a suit yesterday against online music service Pandora at the U.S. Southern District Federal Court in New York. BMI has ended negotiations for publishing rates and is now seeking a determination of rates for a blanket license that covers all music streamed on Pandora. The filing follows Pandora’s controversial attempt to pay lower publishing rates by acquiring a South Dakota terrestrial radio station, in order to become eligible for the blanket license fee.
