A government study finds that while IP theft is commonplace in the world of NFTs, existing laws can be applied to protect U.S. copyright, trademark and patent rights. Those are the findings of a study released this month by the U.S. Patent and Trademark Office in conjunction with the U.S. Copyright Office. The U.S. Patent and Trademark Office has issued revised guidance on patents for inventions created using artificial intelligence, a fast-developing category of intellectual property law. The advisory says patents may cover AI-assisted inventions in cases where “a natural person provided a significant contribution.” Insofar as what constitutes appropriately significant input, the agency is looking for the “right balance” between “awarding patent protection to promote human ingenuity and investment for AI-assisted inventions while not unnecessarily locking up innovation for future developments,” according to a USPTO blog post. The Biden administration has unveiled a new labeling system for smart devices. The U.S. Cyber Trust Mark identifies consumer electronics and appliances that meet security standards and are less vulnerable to cyberattacks. Companies including Amazon, Google, LG, Qualcomm, Samsung and retailer Best Buy participated in announcing the voluntary program. The Connectivity Standards Alliance (CSA), purveyor of the Matter smart home standard, has also pledged support. The program is scheduled to roll out in 2024. Devices bearing the U.S. Cyber Trust Mark will have met security standards established by the National Institute of Standards and Technology (NIST). AI startup Humane, founded by former Apple employees, has raised $100 million in a Series C round to fund its vision to deliver an “integrated device and cloud services platform” for artificial intelligence. That brings Humane’s total funding to $230 million from investors including Salesforce CEO Marc Benioff. This recent round, led by Kindred Ventures, includes Microsoft, SK Networks and OpenAI co-founder Sam Altman. While Humane hasn’t been publicizing its plans, the company — founded by ex-Apple execs Bethany Bongiorno and Imran Chaudhri — drew attention after hiring dozens of former Apple staffers. U.S. District judge Leonie Brinkema just ruled that an artificial intelligence-enabled computer cannot be listed as an inventor on patents and that only humans can be inventors under U.S. law. That’s because, according to Federal law, an “individual” must take an oath that he/she is the inventor and the term “individual” is legally defined as a natural person. The ruling was in response to University of Surrey law professor Ryan Abbott’s effort, the Artificial Inventor Project, to get a computer listed as an inventor. Apple just submitted an application to the U.S. Patent and Trademark Office for a light field panoramic camera system for next-generation iPhones, iPads and head-mounted displays (HMD). With the camera, the user will be able to capture images (as well as position and orientation information) by holding up the device. Processing the images for relative positions and depth information, the light field panorama will allow a viewer to explore 3D views of the image with 6 degrees of freedom (DOF). In a 7-2 vote, the U.S. Supreme Court ruled that an inter partes review (IPR) at the U.S. Patent and Trademark Office does not violate a defendant’s constitutional right to have a case determined by a federal court and jury. Congress created the process in 2011 to handle the large number of flimsy patent applications. The Houston-based Oil States International brought the case; pharmaceutical companies also called the IPR process “a threat to innovation.” Justices John Roberts and Neil Gorsuch were the dissenting votes. NBCUniversal just received a patent to track files, in real-time, shared by groups on peer-to-peer networks, part of an anti-piracy effort. “Early detection of high volume peer-to-peer swarms,” the title of the patent, looks for a popular swarm so that the copyright holders can take action before it is “too late to do much good.” Detection relies on a data feed of peer-to-peer swarm activity, augmented by a data analytics engine that processes the data to identify swarms with parameters exceeding a threshold. The United States Patent and Trademark Office granted leading aircraft manufacturer Airbus a patent in August for headrests that include helmets attached to a carrier. The headrests will relieve passenger stress by providing entertainment in addition to “sensorial isolation with regard to the external environment.” They will play immersive multimedia content on glasses with display screens that are capable of “holographic projection mode,” according to the patent.
